Terms of Service

Draft, not yet reviewed by legal counsel. This is a working draft so we can start pilot testing. Before you deploy to a real school, have qualified legal counsel review it against the India Contract Act, DPDP Act 2023, Consumer Protection Act, and the Play Store / App Store rules.
1. Introduction and acceptance
These terms cover your use of MyKydd: the Parent app, the Driver app, the Admin Dashboard, and the backend that runs behind them (we’ll call all of that “the Services”). Using MyKydd means you accept these terms. If you don’t, don’t use the service.
We run MyKydd from Hyderabad, Telangana, India. These terms are a binding agreement between you and us.
2. Definitions
- MyKydd, we, us, our: the company that runs the platform.
- School: a K-12 school using MyKydd for its own operations. Under DPDP, the school is the data fiduciary for its records.
- You: a parent, guardian, driver, school staff member, or platform admin using the Services.
- Personal Data: information that identifies a person. Details are in our Privacy Policy.
- Services: the MyKydd apps, dashboard, and backend APIs.
3. What the Services do
MyKydd is a school operations platform. What you see depends on how your school has set it up. Features can include:
- Live bus tracking with boarding and arrival notifications
- Classroom and transport attendance
- Guardian pickup verification
- Meal and canteen records (no wallet, no online payments)
- Homework and class announcements
- Manual finance records: invoices and cash, cheque, or bank transfer entries logged by school staff
Not every school turns on every feature.
4. Who can use it
To use MyKydd, you must be one of:
- A parent or legal guardian, 18 or older, using the Parent app for yourself and any linked minor children.
- An adult driver a school has authorised to run its transport.
- A school staff member (admin, office, teacher, finance officer, meal manager, canteen staff) with authority the school has granted you.
- A MyKydd platform admin authorised to operate the Services.
Students don’t sign up on their own. A student’s participation runs through their school and their parent or guardian.
5. Accounts and phone verification
Parent and Driver accounts use Firebase Phone Authentication. You get a one-time code by SMS to prove the phone number is yours. School staff accounts are set up by the school through the Admin Dashboard.
When you register, you’re telling us:
- The phone number is yours and works today.
- You’ll only have one account per phone number.
- You’ll keep your phone, codes, and any dashboard passwords to yourself.
- What happens under your account is on you.
- If you lose your phone number, email support@mykydd.com so we can move the account safely.
If something looks off, we can suspend the account until we’ve confirmed who owns it.
6. What you can’t do
Don’t do any of this:
- Pretend to be someone else, or misrepresent your link to a student, driver, or school.
- Open or access an account, school, or record you weren’t given.
- Scrape or bulk-copy data out of the Services. For example, don’t pull our API to build a competing product.
- Reverse engineer or try to lift our source code, except where the law says you’re allowed to.
- Overload, disrupt, or interfere with the Services or other people using them.
- Use MyKydd for anything other than running a school. No commercial resale, no ads, no political campaigning through our channels.
- Upload malware or anything harmful.
- Break Indian law with it, especially child protection and data protection law.
Do any of this and we can suspend or remove your account. Serious cases go to law enforcement.
7. The school’s role
Under the DPDP Act, 2023, each school using MyKydd is the data fiduciary for its students, parents, drivers, and staff. We’re a data processor acting on the school’s instructions.
In practice, the school:
- Decides who gets invited and what role they hold.
- Owns the accuracy of student, parent, and staff records in its tenant.
- Sets policy for attendance corrections, pickup verification, meal service, and finance workflows.
- Keeps authority over its own data and account.
We run the platform and keep it safe. We’re not the authority on who can see a school’s records. That’s the school’s admin. Access requests go to them.
8. Who owns what data
- Your school owns the operational data it creates: student records, attendance, routes, invoices, ledger entries, homework, announcements.
- You own your own Personal Data: name, phone number, anything else you tell us about yourself.
- We don’t claim ownership of your school’s data or yours.
When a school stops using MyKydd, we return or delete that school’s data per Section 8 of our Privacy Policy, unless the law makes us keep it longer.
9. Intellectual property
We own MyKydd: the code, the apps, the dashboard, the backend, the docs, the name, and the logo. These terms don’t hand any of that over to you.
As long as you’re following these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the MyKydd apps and dashboard for their intended purpose while your account is active. That’s it. No copying, no reselling.
10. Payments and pricing
MyKydd is in a pre-commercial pilot right now. During the pilot:
- The Services are free for participating schools.
- No parent or guardian pays MyKydd anything. We don’t charge consumers.
- Paid school subscriptions, when they arrive, will be covered by a separate written agreement with the school setting out pricing, invoicing, and payment terms.
The manual finance features log school-issued invoices and manual payments: cash, cheque, bank transfer, or a reference to an external payment link that school staff enter by hand. We do not process online payments today. We’re not a payment gateway, a wallet, or a financial custodian.
If we ever add online payments, we’ll update these terms and ask for consent before turning it on.
11. Third-party services
MyKydd relies on other providers to run, as covered in the Privacy Policy:
- Firebase (Google LLC): phone verification and push notifications
- Neon Postgres: managed database hosting
- Oracle Cloud Infrastructure: backend compute
- Cloudflare (planned): DDoS protection and DNS
- Grafana Cloud: logs and metrics for monitoring
We pick providers with solid industry practices, but when you use them through MyKydd their own terms can also apply. We don’t control what they do downstream.
12. Availability and changes
We work to keep MyKydd running, but during the pilot we don’t offer a formal SLA. The Services are best-effort and can go down for maintenance, upgrades, or a provider issue.
We can add, change, or retire features with reasonable notice, especially during the pilot, as schools tell us what works. If a change materially affects how you use the Services, we’ll say so by email or in-app notice.
13. Content you upload
Teachers, office staff, drivers, and admins upload things to MyKydd: homework, class announcements, meal menus, operational notes.
- Content uploaded on the school’s behalf belongs to the school.
- Personal notes and messages you upload as an individual are yours.
- By uploading, you grant us a limited, non-exclusive licence to host, store, transmit, and display that content inside the platform, only to deliver the Services to the right people (for example, showing a homework post to the linked parents).
You’re responsible for what you upload. Nothing unlawful, defamatory, discriminatory, or infringing.
14. Ending your access
You can leave. Email support@mykydd.com from your registered contact and we’ll walk you through account deletion. Some records (a school’s attendance history, a payment ledger) may stay with the school after your personal account is gone.
Your school can remove you. For example, when a child leaves the school or a staff member moves on. That cuts your access to that school’s data, but your Personal Data may still exist in other schools you’re linked to.
We can end this too. We can suspend or terminate your access if you seriously break these terms, if the law makes us, or (after the pilot) if a school hasn’t paid the agreed subscription.
After termination, data handling follows Section 8 of the Privacy Policy.
15. Disclaimers
The Services come “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent the law allows.
A few things worth being direct about:
- MyKydd is software. We are not a transport operator or a child safety service. A student’s physical safety on the bus stays with the school, the driver, and the parent or guardian. Boarding and drop-off are the school’s and driver’s responsibility, not ours.
- Live GPS in the Parent app depends on device telemetry and mobile networks. It lags. It may not be the exact real-time position of the bus. Don’t use it as the only signal for time-critical decisions.
- Notifications (boarding, arrival, approach, missed boarding, pickup handoff) go through Firebase Cloud Messaging and depend on the recipient’s device settings. We can’t promise every notification lands.
- Attendance, meal, and finance records show what school staff entered. We’re not the source of truth for your school’s decisions.
16. Limits on our liability
To the fullest extent Indian law allows:
- We’re not liable for indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, data, goodwill, or business opportunity) arising from your use of the Services.
- Our total liability under these terms in any 12-month period will
not exceed the greater of:
- what the applicable school paid us for the Services in the previous 12 months, or
- ₹10,000 (Indian Rupees ten thousand), which is what applies during the free pilot when no fees have been paid.
Nothing here limits liability the law says we can’t limit, including fraud or wilful misconduct.
17. Indemnification
You’ll cover us (MyKydd, our officers, employees, and providers) for any claim, damage, loss, or expense (including reasonable legal fees) that comes from:
- misusing the Services,
- breaking these terms,
- uploading content that infringes someone’s rights or breaks the law, or
- breaking any law or regulation that applies to you.
18. Governing law and disputes
These terms are governed by the laws of India, without applying conflict-of-laws rules.
If we have a disagreement, let’s try to sort it out with a conversation first. Email support@mykydd.com and give it a genuine 30 days of good-faith negotiation.
If that doesn’t work, the courts of Hyderabad, Telangana, India have exclusive jurisdiction, unless mandatory consumer protection law in your state says otherwise.
19. Changes to these terms
We’ll update these terms as MyKydd evolves and as the law requires. When we do:
- The “Last updated” date at the top changes.
- Material changes get an email and in-app notice.
- If you keep using the Services after the new version takes effect, you’ve accepted it.
If you don’t like a change, stop using the Services and email us to close your account.
